Settling A Malpractice Lawsuit
Filing a lawsuit basically means practicing your right as an individual who is eligible to have the benefits of the law. Thus the process of settling a lawsuit can be a baffling event if you are not fully aware of the various lawsuits applicable in a particular situation. With the growing number of crimes, there is a proportional advancement in the lawsuits as well, associated with those crimes. The most common form of transgression on an individual's part is Malpractice. And there are various different types of malpractice lawsuits, like professional, medical and legal and malpractices. Filing for more than one type of lawsuit is also allowed. Below are some of the typical malpractice lawsuits:
- Legal
Legal Malpractice can be defined as an awful conduct by a legal professional while performing his/her duties. Usually a legal malpractice lawsuit is generally brought against attorneys who do not adequately represent a client in the court. Also in instances where the attorney is unable to bring up important statutes, examine proof or present the facts, a person may bring a legal malpractice claim against him/her.

Legal malpractice include poorly written legal documents, excessive litigation at the client's expense, dishonesty, wrong legal advice, errors in the legal documents that result in the dismissal of the client's case, and more.
- Medical
Medical Malpractice basically means poor conduct by a medical professional, a doctor or a nurse, while continuing with his/her duties. Medical malpractice may or may not be intentional as it can happen because of carelessness as well. If you or your relative suffered an injury or death because of the negligence of a surgeon, or a dentist, or nursing home staff, or pharmacy technicians etc, then the medical malpractice lawsuit can be filed.
Examples of Medical Malpractice are birth injuries i.e. injury to child or mother during the birthing process, inability to identify serious problems like cancer, heart attack, improper medication such as giving excess amount of anesthesia, or giving wrong medicine as a result of unreadable medicine-names on the prescription, failure to inform the patient of available treatments or poor treatment i.e. expired drugs or medical products, abandonment i.e. failure to attend to a patient and other medical injuries.
- Professional
Professional Malpractice is an unpleasant conduct on part of a service professional while carrying out his/her duties. Basically this type of lawsuit can be filed against the financial consultants, invoicing companies, accountants, and other white-collar service people if the trust is broken. Examples of professional malpractice lawsuits include fraudulent dealings by stock brokers, misinterpretation of figures, misleading statements, billing scam- by an accountant or by an invoicing company, unlawful transactions by an individual with a power of attorney, misreported facts, and other frauds by a service professional.
As per some surveys the number of surgical mistakes made in the United States each year is alarmingly high - and medical malpractice insurance policies are skyrocketing. Thus, the knowledge of these lawsuits is very important. Many, if not all, of these surgical errors can be avoided by having appropriate knowledge of corresponding lawsuits.
