Are You Ready To Go To Trial?
As the procedure behind the lawsuit settlement is very complicated at times, therefore one must have complete knowledge of various issues to be considered before chasing a civil or any other lawsuit. There are few important lawful questions one must ask. First and foremost question is whether the claim is valid or not. A case is considered to be valid in which grievances can be settled by legal action. For example, say you decided to take a cruise and the ship captain due to his negligence, ran the ship ashore. Consequently, you got injured. You would have filed a negligence case against the captain and the cruise company. But suppose it was gloomy for the whole duration of the cruise. Now if the cruise company had not specifically guaranteed of clear weather (which is most unlikely), your annoyance has no legal cure.
Next very issue under consideration is whether you have a standing or not? That is, to set off a lawsuit you must have standing, which primarily means the incidence must have had an impact on you at hand. As you can't sue anyone if something goes wrong until it does not have any bad impact on you. For instance, you cannot sue a local architect if the building is extremely ugly. But if, however, the building is adjacent to your home and somehow directly encroach on your premise, then you may have the standing and thus, can try to bring the development process to an end.
Every state has its own laws that require each lawsuit must be brought within a certain period after injury. The time limits do vary from state to state and also from case to case. Time limit may be as little as 30 days, but is often less than six years. Sometimes the injury is not instantly noticeable; for instance, say a worker has been exposed to a material which causes cancer or tumor many years later; then the worker can file the lawsuit when he/she gets aware of the disease. In medical malpractice cases, some provinces have strict rules regarding the time limits within which a person can file a lawsuit.

Now once you have considered all the above mentioned issues regarding the filing of a lawsuit; the next question need to be answered is whether the lawsuit can actually solve your dilemma or not. You may have grievances with someone but filing a lawsuit won't necessarily help. So first of all you must analyze your chances of winning the lawsuit. As time, effort and sometimes even money staked in a lawsuit can't always worth it, so objective analysis is must. Also you must consider the personal effect of court case as other party will equally try to harm your reputation and discredit your claims, and that can definitely be one of the agonizing parts of the litigation process. And there can be unnecessary publicity drawn because of the case, so you must consider all these issues before going to trials.
